A Fortune 50 company was faced with a one-week deadline to review a significant volume of data – approximately 131,000 documents – on a vital matter.
When the call came to Counsel On Call at 8:00 p.m. on a Friday evening, team leaders quickly coordinated with the client’s outside counsel and jumped into action. Because Counsel On Call was already familiar with the client, its custodians and business issues, no ramp-up time was needed and COC was able to alert the rest of the client’s core COC attorney team to be ready for a project at any moment.
Even so, there were challenges in assembling such a large team of attorneys on such a deadline, tailoring the review and quality control protocols, conducting orientation, and fully completing the project in a cost-effective manner that would ensure 100% quality control.
Fortunately, the Counsel On Call project manager (PM) had previously vetted several technology companies and believed one — having recently tested its promising predictive coding platform — could be a solution for this matter. At the time, the technology had been used on a large scale only in other professions.
The PM knew the tool would excel with email and Word documents and quickly get to the responsive data in the 131,000-document corpus, leaving a much more manageable set of documents for the attorney team to review by the deadline. He recommended the tool to the client as the best solution among the other options he presented.
The client and outside counsel trusted Counsel On Call’s recommendation. The team members immediately engaged to oversee the project, train the tool and set up the system so outside counsel could conduct simultaneous key term testing and quality control from New York. COC provided reports on an hourly basis over the weekend, measuring how the tool was being trained and the documents it was pulling as responsive, and worked with outside counsel to reﬁne key terms on a real-time basis.
With the Counsel On Call team’s expert leadership and onsite guidance, the technology-assisted review (TAR) tool performed well, and outside counsel and the client were very pleased with the document reduction results: only 32,000 documents remaining to review, with a 70% responsive rate. Counsel On Call’s team of 22 attorneys conducted the rest of the review and met the imposed deadline using stringent quality control protocols. The total savings on the one-week project were $762,200 compared to how the client would traditionally have handled the matter.
This was one of the ﬁrst large-scale uses of predictive coding in the industry. The client continues to use Counsel On Call’s managed review model today and has utilized multiple technology platforms based on COC’s suggestions, saving more money and developing reﬁned protocols with each successive matter. This case was just one step in the evolution regarding how Counsel On Call fully integrates TAR into every managed review matter; COC continues to impartially test new platforms to get the best possible results in an efficient and cost-effective manner.
